Notarial fees vary depending on the type and complexity of the notarial act. The total notarial cost paid at a notary office consists of the notary’s fee and the taxes/charges owed to the state by the client.
How the notary fee is calculated
The notary fee is established by order of the Minister of Justice (O.M.J. no. 46/C/2011). According to this regulation, some acts are charged with a fixed fee, while others are subject to a progressive or percentage-based fee depending on the determined or determinable value of the transaction.
- Income tax on the transfer of real estate from personal assets, in accordance with the Fiscal Code (this tax is paid to the State Budget and local budgets);
- Land Book registration fees (ANCPI);
- Verification or registration fees in the national registers managed by the National Union of Notaries Public National Registers Administration Center (CNARNN).
